These Terms of Use apply to your use of www.highbartrading.com (the “Site”), operated by Highbar Trading Co. (“Highbar,” “we,” “us”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
About the Site
The Site provides information about Highbar's products, services, and programs for businesses. Purchases are made through a Highbar customer account, our online ordering site at shop.highbartrading.com, or directly with a Highbar representative, and may be subject to additional terms, quotes, contracts, or program agreements. If those terms conflict with these Terms of Use, those terms control for that purchase.
Product, pricing, and availability information
We work to keep information on the Site accurate, but product descriptions, availability, images, and program details may change and may contain errors. Pricing and availability are confirmed at the time of order. Manufacturer names and trademarks shown on the Site belong to their owners and are used only to identify products.
Delivery
- Next-day delivery: In-stock items are delivered the next business day, free, on Highbar trucks within our delivery area.
- Same-day delivery: Available for in-stock items to addresses within 45 minutes of our Memphis warehouse (38118) when ordered by 12:00 pm and relayed to your Highbar representative. A same-day delivery charge applies to cover the courier fee.
- Delivery times are goals, not guarantees, and may be affected by weather, supplier delays, or other events outside our control.
Returns
Most items can be returned within 30 days. Food and dated goods cannot be returned. To start a return, contact your Highbar representative or our customer service team.
Using the Site
You agree not to misuse the Site, including by submitting false or automated form requests, attempting to access systems or data you are not authorized to access, interfering with the Site's operation, or using the Site for any unlawful purpose.
Our content
The text, graphics, logos, and other content on the Site belong to Highbar or its licensors. You may view and print pages for your own business use, but you may not copy, modify, or redistribute Site content without our written permission.
Links to other sites
The Site may link to websites we do not control. We are not responsible for their content or practices.
Disclaimer
The Site and its content are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. Product warranties, where they apply, are provided by the manufacturer or under the terms of your purchase.
Limitation of liability
To the fullest extent permitted by law, Highbar is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site.
Governing law
These terms are governed by the laws of the State of Tennessee. Any dispute related to the Site will be handled in the state or federal courts located in Shelby County, Tennessee.
Changes to these terms
We may update these terms from time to time. When we do, we will change the effective date at the top of this page. Continued use of the Site means you accept the updated terms.
